Tustin Lobsterfest Volunteer Waiver
I hereby certify that I am the adult parent or legal guardian of those children named below, all of whom are under the age of eighteen years (“Child(ren)”). On behalf of myself and my Child(ren), I hereby release the Tustin Lobsterfest Committee, City of Tustin, Tustin-Santa Ana Rotary Club, Peppertree Park, The Tustin Area Senior Center, all representatives and agents of any of the foregoing, and all municipal agencies whose property and/or personnel are used, and other sponsoring company(ies), Aagency(ies), or individual(s) (collectively, the “Released Parties”) from responsibility for any injuries or damages I/my child(ren) may suffer as a result of participating in the Tustin Lobsterest. I hereby certify that I/my child(ren) am/is in good condition and able to safely compete in this event. I will additionally permit use of name and pictures of me/my child in broadcasts, telecasts, newspapers, brochures, etc. I have read the volunteer information provided for the event and certify compliance by me/my child by signature below. IF VOLUNTEER IS UNDER AGE 18, this is to certify that my child(ren) listed below, has/have my permission to compete in the Tustin Lobsterest, is/are in good physical condition, and that event officials have my permission to authorize emergency treatment if necessary.
In consideration of you accepting this entry, I, the participant, on my behalf and on behalf of my Child(ren) intending to be legally bound do hereby waive and forever release any and all rights and claims for damages or injuries that I may have against the Released Parties, and all of their owners, directors, officers, agents, volunteers, and contractors assisting with the event, sponsors and their representatives, volunteers and employees for any and all injuries to me, my Child(ren, or my/their/our personal property. This release includes all injuries and/or damages suffered by me or my Child(ren) before, during or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators, or assignees, as well as the heirs, executors, administrators or assignees of my Child(ren).
I know that volunteering could potentially be a hazardous activity. Neither I nor my Child(ren) should volunteer unless I/they/we am/are medically able to do so and properly trained. I assume all risks associated with voluntering in this event including, but not limited to: falls, contact with other participants, the effects of weather, traffic, and event conditions, and waive any and all claims which I might have based on any of those and other risks typically found in volunteering. I acknowledge all such risks are known and understood by me. I agree to abide by all decisions of any event official relative to my ability to safely complete the volunteer. I certify as a material condition to my being permitted to volunteer, that I am physically fit and sufficiently trained for the event.
In the event of an illness, injury or medical emergency arising during the event I hereby authorize and give my consent to the Event Director to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me and/or my Child(ren)including but not limited to medical transport, medications, treatment and hospitalization. As it applies to my participation in this event, I agree, and shall cause by Child(ren), to abide by the Center for Disease Control (CDC)’s recommendations for the prevention of the spread of COVID-19 and attest to having read the CDC’s guidance at: https://www.cdc.gov/coronavirus/2019-ncov/prepare/prevention.html. I also agree to abide by any COVID-19 distancing and other safety guidelines issued by the state, the community or by this race for my participation in this race.
Further, I grant permission to all the foregoing to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, videographic or electronic recording, including all of the foregoing of my Child(ren), of this event for legitimate purposes.
This event follows the standard volunteer industry policy: We reserve the right to postpone or cancel the event due to circumstances beyond our control such as a natural disaster or emergency or as required to protect the safety of participants and staff. We reserve the right to change the details of the event without prior notice. By volunteering, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver.
